• Everyone who operates a motor vehicle or vessel or operates or assists in the operation of an aircraft or of railway equipment or has the care or control of a motor vehicle, vessel, aircraft or railway equipment, whether it is in motion or not, (a) while the person’s ability to operate the vehicle, vessel, aircraft or railway equipment is impaired by alcohol or a drug; or (b) having consumed alcohol in such a quantity that the concentration in the person’s blood exceeds eighty milligrams of alcohol in one hundred millilitres of blood, has committed the offence of impaired driving.
  • Penalties for a first offence include: suspension of your driver’s license for one year, a fine of no less than $1000, participation in an alcohol treatment program, installation of an ignition interlock system in your vehicle for one year, and a criminal record.
  • Penalties for a second offence include: suspension of your driver’s license for three years, imprisonment of 30 days (minimum), participation in an alcohol treatment program, installation of an ignition interlock system in your vehicle for one year. The value of the fine for a second offence is determined by the judge.
